The Office of Regulatory
Services (ORS) undertakes licensing, registration and accreditation, dispute
resolution and consumer and trader assistance, compliance and
enforcement/litigation, and education.
Associations are
responsible for the annual reporting of their status to the
Registrar-General in accordance with the Associations
Incorporation Act 1991 (external webpage).
Associations, or not for
profit organisations, may apply to the Office of Regulatory Services
(ORS) for
incorporation in the ACT under the Associations Incorporation Act 1991 (external webpage).
The incorporation of Associations provides the public record of the
financial affairs and status
of an association, and of changes to its key personnel. All Preschool Parent Associations and the CPS are incorporated associations - CLICK HERE to read more about the benefit of this (CPS webpage).
Incorporation provides
associations with legal status and places certain obligations upon
them,
including establishing and maintaining their public
record. To this end, incorporated associations are required to lodge
with the ORS annual financial statements, notification of changes to
their
committees, public officers and registered offices. Associations are
also required to notify the ORS when they resolve to change their
name,
amalgamate with another ACT incorporated association or to voluntarily
wind
up.
Certain documents held
by the ORS are not available for public scrutiny, including
correspondence between the ORS and proprietors of business names,
although
they may be available under the a request via the Freedom of
Information
Act 1989.

- Associations
Incorporations Act 1991 This is the legislation that governs Incorporated Associations.
- Associations
Incorporations Regulations 1991 This contains the Model Rules. These are the "fall back" constitution for all constitutions - when the Association's constitution is unable to assist the association to manage their affairs. They start at about page 8. This is where you can find out about how to hold general meetings and how to transact business when there is no quorum. Look at Model rules Schedule 1 General meetings Part 1.4 Section 25 General meetings - procedure and quorum Items 3 and 4. (page 27).

The information below does not seek to
replace the information that is to be obtained from the Registrar
General's Office - it is aimed to give you a brief understanding of the
processes involved when an Association needs to reassess its entity, its
obligations and responsibilities. More information should be sought
from the Office of Regulatory Services Website, and, of course,
we urge you to seek out independent legal advice - due, mostly, to the
fact that we are not equipped to be your Association's legal counsel.
