Constitutions

Each Preschool or Playschool Parent Association have adopted a statement of purpose and rules or, as it is more commonly referred to, a constitution.

A constitution outlines the rules of governance, operational and administration processes, membership rights and obligations, and disciplinary procedures. Click here to download a copy of a standard Preschool Parent Association constitution.

When a constitution is reviewed - everyone needs to get involved.

If a Parent Association is seeking to manage an amalgamation or closure, they will need to set key dates for establishment of the winding-up or amalgamation of the Parent Association.

This is managed in accordance to the Parent Association’s own Constitution.
Alterations.

In the event of a preschool or playschool seeking to alter a part of its constitution; for example: membership eligibility or criteria, or the association's aims or objectives, the Office of Regulatory Services states:

"An association may alter its rules, objects and purposes by a special resolution.

If an association resolves to alter its rules, objects or purposes, it must notify the ORS using Form A8 "Alteration of Objects, Purposes or Rules".

The form must be lodged within one month of the date that the special resolution was passed.

The form must be signed by two current committee members and be accompanied by the prescribed fee.

In addition to the form, associations must lodge a copy of the revised rules.

If the changes to the rules are valid under the Act the ORS will accept the changes and the new rules will form part of the public record of the association ."

PLEASE NOTE: Information on this page is provided as a guide ONLY.  For current information, please refer to the Office of Regulatory Services Incorporated Associations Practice manual and the Office of Regulatory Services website for up-to-date requirements and fees.

IT IS IMPORTANT TO REMEMBER THAT ANY CHANGE MUST BE LODGED WITH THE REGISTRAR GENERAL'S OFFICE (WITH THE PRESCRIBED FEE).
